I located a letter (fax) from Adam Kinser to Judge R Larry Lewusm dated March 26, 09
advising him that the cases called out had been settled.  One case was Angela Reed, college loan, and the two others were reimbursement of the insurance moneys and  mother's half of the logging done on the property.
 
Richard Kennedy was cc'd.
 
I also have a directive from Quillen's court in Oct, listing these cases and moving them to an unnamed date in December, 08.
 
I am assuming that Dec date is when Kinser stood up and announced these cases had been settled for the amounts I have stated.  Mother was alive at this time and I have corespondence attempting to collect this money.
 
These cases were filed by Wayne and possibly he signed off on the settlements or gave permission to the attorneys to sign off.  He will have to provide that information. They had been set for May 13, 2009 but because of the settlement they were dismissed and removed from the courts docket.
 
I will send copies of the 'play it forward' October mention and the March 26, 09 letter from Kinser to Judge Lewis.  I would like to think this is enough information for you to confirm that LKJ does indeed owe this money to mother's estate as mother was alive at the time LKJ stole the money, at still alive at the time the cases were settled.

It occurs to me that you don't know anything about this $14,000.

LKJ would certainly not volunteer to tell you.

For several months dad's caregivers turned in their claims as usual.  I want to say late 07 and spring of 08. When the insurance checks were deposited into dad's bank account, LKJ did not pay the caregivers but kept the money. I had to make up pay to the caregivers from mother's money as parents required 24 hr care.

 Over several months, this added up to $14,000 and was documented to the courts satisfaction and LKJ & her lawyers agreed she was to pay it.  She never did.  I doubt LKJ will willingly admit to this but if her lawyer is capable of telling the truth he will confirm this.

Mother's Will and Probate 1.20.09

Mother passed away at 2PM at my home, next door to where elizabeth and Daddy were in his house. EMS was called and they put Mother in the ambulance to take her to the hospital (no lights). elizabeth got into her car and followed the ambulance to the hospital. elizabeth showed up the next morning at 9:15 to file Mother's will and probate with Death Certificate at Lee County Courthouse.

Mother's will left everything to the surviving spouse, then to the 3 children. When elizabeth had Daddy changed his will leaving everything to her, this meant that when Mother died everything, except the property which was in a living trust, went to elizabeth. elizabeth apparently wanted it NOW!

You ask me if there was anything else going on and I said no. Well, maybe. It's so ongoing that it all runs together. 

Within the last couple of weeks the health care company that provides visiting nurses to check on mother and also provides the ambulance service for mother canceled the contract with mother AND father because of the continued unrest caused by Elizabeth and they were concerned about the safety of their personnel. Mother was in the hospital a couple of weeks ago and when she was being discharged Gail was informed that mother couldn't be released because there was no home health service for mother. Gail called me, I called Homehealth and was informed  the day they came to the house and realized mother was in distress (subsequently moved to the hospital) they informed Elizabeth they would no longer be under contract and the reason, but Elizabeth did not inform Gail, therefore leaving mother without home health care.

The bed location was to be determined by Joe Rasnic, and was ultimately decided by Dr. Litton and Joe to use the living room (see above link to pics). When Elizabeth arrived it was told to me that she was in a rage when she saw the room dividers (which were movable) were between mother and daddy's bed. In the house was mother, Charlsie, Angela (caregiver) and neighbor Misti McCowan. Angela called Gail and told her of the situation. Elizabeth left the house. Elizabeth returned after X time, grabbed a room dividers, shoved the divider around mother's bed and into the garage during this time is when, I believe, the altercation with Charlsie occurred. As she was moving the second divider Misti stopped Elizabeth and brought the second divider from the garage back in the bedroom. During this time Angela called Gail, Gail said to call the Sheriff. I believe the Sheriff told Elizabeth to leave the house. Elizabeth filed a charge against Misti for destruction of property claiming the floor was scratched. I saw the floor a couple of days later and saw no scratch. The floor was scuffed and I'm sure I did it some when I brought the dividers in, Elizabeth when she was shoving the dividers through the room and anyone else that touched the dividers.

Daddy a couple of years ago made a portable wooden wheelchair ramp for mother. I brought mothers portable ramps to my house because they were mothers and needed in my house because I have multiple levels. I took the wooden ramp of daddy and put it again the front door of their house for daddy to use. The next day Charlsie found the ramp  between the two rear wheels, at the bumper of the car she drives. 

This is living with Elizabeth. And the beat goes on.

Good morning. Mother was discharged yesterday (not uneventful) and is getting settled in comfortably along with Remy and Charlsie at my house. Maybe it was the promise by Gail to bring a wine spritzer. It seems that when the home health care nurses showed up at mother's and ultimately recommended she go to the hospital, it was not a routine visit. The home health care providers were dispatched to cancel the contract for fear of their nurses due to Elizabeth calling the Sheriff's office 3 times for an officer and Elizabeth being charged with assault on Charlsie (witness by Angela). Unfortunately, only Elizabeth was informed of the cancellation, she didn't tell Gail, so when mother was due to check out of the hospital, the hospital they would not discharge her because she had no home health care provider, which also provided the ambulance. Needless to say, Gail started to scramble and ultimately secured another provider and was able to get her moved. 

While Elizabeth was gone and we have a key, I was able to get the lift chair, dividers, ramps, some linens and such from mother and dad's house yesterday. When I was there I saw a stack of medal flip loop type motel locks that Elizabeth apparent intends to install on all outside doors of the house. We would like to avoid the drama scene that Elizabeth wants to create and also avoid the door frames being damaged by the installation. I have a sawzall, so it's pretty easy to get in. There are going to be things that mother needs that are at their house and we aren't going to call Elizabeth to plead with her to let us in. If an email to Kinser for a couple of hours during the day that if we need something we can go into the house without being forced to call Elizabeth for permission it would take some drama away from her. If this is something better done by Rich, let me know. Thanks.

When we were in court in Oct., dad complained at length about paying for mother's food and asked that mother be made to kick in half the grocery bill.
If you don't remember, it should be in the records..if there are records.

As they say in LA,...can't you just feel the love.

Mother's Blue Cross has covered dad since approx 1956.  This year alone, BC has paid out approx $40,000 for his medical bills...and that's not including this latest week-plus stint in ICU.

And by the way, and try to look surprised, sister also uses dad's money to buy food and hauls it back to Ohio.

10.25.08 Money due to Bishop

Hi, Karen.

Bear with me as I try to round up all the monies owed to mother by her daughter, my sister, Liz King Jones and/or father.

Sister has almost always had an on-going loan.  Last was approx $35,000 from 2002/03.  This was to buy the Lexus wagon she is now driving.  This might have included money still owed from previous loan for husband Woody's Toyota truck. Her monthly payments were $539, per 12/03/07 depo.

April 14, 2007 she e-mailed that she still owed approx $7,000 and had one year left to pay.  Same e-mail, she said daughter Angie owed $4,500. Based on check copies supplied by Angie, she still owes $7,600.  I think sister also understated what's due. Question is, how much does she really owe.

Parents had two joint checking accounts when I arrived here in June, 2007.
From June until they were closed - Oct., approx end of year - I never saw a payment given to parents or deposited into either account.

In the 12/03/07 depo she said she bought a van for $10,000 (I've also heard $11,000) in Oct. with a home equity loan and is paying herself back with the $539 per month.  This van was to be used to drive parents around.  This purchase was not discussed with me - mother's conservator and co-guardian - and I certainly would not have agreed to it. Mother's dr ordered that she was not to be taken out of the house without his permission. If father authorized it, he can pay for it.  Sister and husband are on title.

New subject:  rent.  A small house on the property is rented at $250 per month.  Father/sister receives this 1st of each month.  I think mother is entitled to half, starting with my conservatorship 7/07.

New subject: digital right of way installed on property.  Father/sister received $1,000 or more since 7/07.  Mother is entitled to half.

New subject: cargo trailer.  Sister took this to Ohio to sell.  Brother Wayne thinks it is worth $500/600.  Where's mother's share?

New subject:  safe deposit box.  Sister emptied this out and closed it out.  What was in it?  Anything of value? Bonds?  Mother has bought bonds in the past. We have a right to know.

New subject:  2006 and 2007 income tax returns.  Sister took it upon herself to file these returns.  Wayne and I have asked for but not received copies of 2006 tax return. Lyndon Livesay, CPA, Pennington Gap, filed parents' taxes for 20+ years.  I took mother's 2007 paperwork to Livesay's office, with word to sister that I did not - did not - want her to file mother's 2007 taxes.  Apparently, however, she did anyway. Who signed for mother???  We need to see what she did.

Added to the money taken directly from Lee Bank & New People's Bank, the money received from the insurance co but not paid to the caregivers, the money from lumber, the money owed by daughter Angie, etc., I think this might be it.

I have about 2 lbs of bank records that were subpoenaed by Sturgill & Kennedy. Want them?  I can supply copies of e-mails referenced, depo's, etc.  Let me know what you need.
